Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the Plazawebsite and services (the “Service”), operated by Cristian Silva, doing business as Plaza(“Plaza,” “we,” “us”). By using the Service or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.

3. Your account

Some features require an account. You agree to provide accurate information, keep your password confidential, and accept responsibility for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Marketing communications. By creating an account, you agree to receive marketing and promotional emails from Plaza. You can opt out at any time using the unsubscribe link in any such email. Transactional messages about your orders and account are not marketing and will still be sent.

4. Our marketplace

Plazais a curated marketplace. Products are supplied, fulfilled, and shipped by independent third-party brands (“Brands”) through our fulfillment partners. Plaza facilitates your order and the storefront experience; the applicable Brand is responsible for manufacturing and product quality. Product descriptions, imagery, and availability are provided by Brands and may contain errors or change without notice.

5. Orders and acceptance

Your order is an offer to purchase. All orders are subject to acceptance and availability, and we or a Brand may decline or cancel an order—including after you receive a confirmation—for reasons such as product or pricing errors, suspected fraud, or stock issues. If we cancel a paid order, we will refund the amount charged.

6. Pricing, payment, and taxes

Prices are shown in U.S. dollars and may change at any time. Payment is processed by our payment provider, Shopify, at checkout; Plazadoes not receive or store your full card details. You authorize us and our provider to charge your selected payment method for the total, including applicable sales tax and shipping, which are calculated at checkout. If a product’s listed price was incorrect, we may cancel and refund the order rather than honor the erroneous price.

7. Shipping and delivery

Orders ship from Brands’ facilities. A flat shipping fee of $6.99 applies per order regardless of the number of Brands in your cart, unless otherwise stated at checkout. Delivery estimates are not guarantees. Risk of loss passes to you upon delivery to the carrier. Plaza currently ships only within the United States.

8. Returns, refunds, and cancellations

  • Window. You may request a return within 30 days of delivery.
  • Condition. Items must be unworn, unwashed, and returned with original tags and packaging.
  • Return shipping. Return shipping is paid by you, except where an item arrived defective, damaged, or incorrect, in which case we cover it.
  • Non-returnable. Intimates, underwear, and items marked final sale are not eligible for return.
  • Refunds. Approved refunds are issued to your original payment method after we or the Brand receive and inspect the return.
  • Cancellations. You may cancel an order before it has been fulfilled by contacting us; once fulfilled, the return process applies.

Individual Brands may set specific return rules for their products, which will be disclosed where applicable.

9. Intellectual property

The Service, including the Plaza name, logo, and site content, is owned by Plaza or its licensors and protected by law. Brand names, logos, and product content belong to their respective owners. You may not copy, scrape, or use our content or marks without permission.

10. Acceptable use

You agree not to misuse the Service; interfere with its operation or security; use bots or scrapers; infringe others’ rights; submit false information; or use the Service for any unlawful purpose.

11. User content

If you submit reviews or other content, you grant Plaza a non-exclusive, royalty-free, worldwide license to use, display, and distribute it in connection with the Service. You are responsible for content you submit and represent that you have the right to submit it.

12. Third-party services

The Service relies on and links to third parties, including Shopify for checkout and payments, our Brands for fulfillment, and mapping and address providers. We are not responsible for third-party services, and your use of them may be governed by their own terms.

13. Disclaimers

THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAZA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold Plaza harmless from claims arising out of your misuse of the Service or violation of these Terms.

16. Changes

We may modify or discontinue the Service and update these Terms at any time. Material changes take effect when posted with an updated effective date; your continued use of the Service means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Utah, and you consent to their jurisdiction.
